Service: IMG Alt Gen — AI Alt Text Generation (the “Service”)

1) Acceptance of Terms
By creating an account, linking the WordPress client plugin, or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that entity.
2) The Service; SaaS Model
The WordPress plugin is an interface to our hosted Service. Core functionality (AI captioning/alt-text generation, token balance, usage metering) runs on our servers and trusted subprocessors. The plugin contains no premium code and requires internet access and authentication.
3) Eligibility & Accounts
- You must be at least 16 years old.
- Provide accurate registration information and keep credentials secure.
- You are responsible for activity under your account and must notify us promptly of any unauthorized use.
4) Tokens, Plans, Billing, Taxes
- Tokens/Credits. Usage is billed via tokens, subscriptions, or a hybrid model. Token balance and consumption appear in your account dashboard.
- Billing. Subscriptions (if any) renew automatically unless canceled before the renewal.
- Refunds (Token Purchases). You may request a refund of unused tokens by emailing contact@arcticfoxdevelopments. Refunds are issued at the closest package amount based on your unused token balance, in the currency of purchase. Current packages include:
- Starter — 50 tokens — 0.99
- Basic — 100 tokens — 1.89
- Standard — 250 tokens — 4.49
- Professional — 500 tokens — 8.49
- Business S — 1,000 tokens — 15.99
- Business M — 2,500 tokens — 37.49
- Business L — 5,000 tokens — 69.99
- Business XL — 10,000 tokens — 129.99
- Ultimate — 25,000 tokens — 299.99 We may request reasonable verification to prevent abuse. Transaction fees (e.g., payment-processor fees) may be netted from refunds where applicable by law.
- Taxes. Prices exclude any applicable taxes (e.g., VAT/GST); you are responsible for them unless required law dictates otherwise.
5) Fair Use & Technical Limits
To preserve stability, we may apply rate limits, batch caps, or concurrency limits. Automated scraping, credential sharing beyond license scope, bypassing limits, or other abuse may result in throttling or suspension.
6) Acceptable Use
You will not use the Service to: (a) violate laws; (b) infringe IP/privacy/publicity rights; (c) generate or disseminate unlawful, hateful, or harassing content; (d) probe or disrupt the Service; (e) upload malicious code; (f) reverse engineer or circumvent security or usage controls.
7) Customer Content; Licenses
“Customer Content” includes images/media you submit and any data necessary to generate alt text. You retain your rights in Customer Content.
You grant Provider and its subprocessors a worldwide, non-exclusive license to host, process, transform, and transmit Customer Content solely to deliver the Service (including quality assurance, minimal caching for reliability, and troubleshooting).
Model training. By default, we do not use Customer Content or outputs to train models and we do not retain customer media beyond transient processing for generation, unless you explicitly opt in.
8) Outputs & Accuracy
AI outputs may be incomplete or inaccurate. You are responsible for reviewing outputs before public use (e.g., for accessibility compliance and brand fit).
9) Third-Party Services & Models
We use trusted providers to deliver the Service, including Stripe for payments and Hostinger for hosting. We remain your service provider and contract with subprocessors under appropriate data-protection terms.
10) Intellectual Property
Except for Customer Content and outputs licensed above, the Service (software, UI, documentation, logos) is owned by Provider and its licensors. No rights are granted except as expressly stated.
11) Confidentiality
We treat non-public information you provide that is marked or reasonably considered confidential as confidential and use it only to deliver the Service, protecting it with reasonable safeguards.
12) Privacy & Data Protection
We process personal data according to our Privacy Policy, which is incorporated by reference. Where applicable, we act as: (i) controller for account and billing data; (ii) processor/service provider for Customer Content.
13) Security
We implement reasonable technical and organizational measures. No system is perfectly secure; you are responsible for your environment (e.g., WordPress access control, plugin updates).
14) Service Changes; Beta
We may modify, add, or deprecate features with reasonable notice. Beta/experimental features are provided “as is” and may be withdrawn.
15) Availability & Support
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance may occur. Support channels and targets are described in your account or documentation.
16) Term; Termination
You may terminate at any time via your account. We may suspend or terminate for cause (e.g., breach, fraud, security risk). Upon termination your access ceases; we may retain limited records as required by law or for legitimate business purposes (see Privacy Policy).
17) Disclaimers
EXCEPT AS REQUIRED BY LAW OR EXPRESSLY STATED IN WRITING, THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
18) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO PROVIDER IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
19) Indemnification
You will defend and indemnify Provider against third-party claims arising from your unlawful use of the Service or from Customer Content you submit.
20) Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that a party may seek interim injunctive relief in any court of competent jurisdiction.
21) Export & Compliance
You will comply with applicable export, sanctions, and anti-corruption laws.
22) Changes to Terms
We may update these Terms from time to time. Material changes will be notified in-product or by email. Continued use after the effective date constitutes acceptance.
